Terms and Conditions

1 General scope

Tradiziun GmbH reserves the right to change these Terms and Conditions at any time. The version of these Terms and Conditions applicable at the time of the order shall prevail; these cannot be unilaterally changed for that order. Any terms and conditions that conflict with or deviate from these Terms and Conditions are not recognized.

Deliveries are made exclusively to addresses in Switzerland or Liechtenstein.

The offer is valid as long as the product can be found via the search engine in the online shop and stocks last.

2 Information

2.1 Products, prices and shipping costs

Images of products in advertisements, brochures, online shops, etc. are for illustrative purposes only and are non-binding.

The shipping costs amount to CHF 9.00 per order up to an order value of CHF 100.00.
Shipping is free for orders over CHF 100.00.
We reserve the right to make partial deliveries.

2.2 Availability and delivery time

We attach great importance to accurately indicating the availability of products in our online shop. However, delivery delays may occur, particularly due to demand, production, or delivery bottlenecks. Therefore, all information regarding availability and delivery times is subject to change without notice.

3 Conclusion of contract

The products and prices in the online shop are considered an offer. If the price information is obviously incorrect, the offer is invalid. If a product is no longer available, any contract concluded through the order will be terminated.

A purchase contract is concluded as soon as the customer places an order in the online shop, in the store, by telephone or e-mail.

The arrival of an online order will be indicated by an automatically generated order confirmation sent to the specified email address. Receipt of the automatically generated confirmation does not constitute a guarantee that the product can actually be delivered. It merely indicates that the submitted order has been received and, thus, the contract has been concluded subject to availability and the correct price.

4 Delivery date

We strive to keep delivery times as short as possible. If a product is available, it will typically be shipped within 3-4 business days. If availability is not available, Tradiziun GmbH will contact the buyer and work out a mutually acceptable solution.

5 Delivery / Collection

The customer's delivery address must be in Switzerland or Liechtenstein and easily accessible by post. If this is not the case, the customer will bear any additional costs.

If a product ordered for pickup is not picked up from the store within 14 days of the notification that it is ready for pickup, the item may be returned to regular stock. There is no longer any guarantee of availability.

6 Damage case

Customers must immediately check delivered or picked-up products for accuracy, completeness and delivery damage.

In the case of freight forwarding deliveries, any delivery damage must be noted on the delivery note.

Damaged, incorrect, or incomplete deliveries must be reported within 5 working days of delivery or collection. The original packaging must be retained.

7 Guarantee

The statutory warranty period of one year applies from the date of delivery or collection. If certain suppliers offer longer warranty periods, these will be transferred to the customer.

Wear parts such as batteries, rechargeable batteries, power cables, adapters, light bulbs, and candles are excluded from the warranty. Otherwise, the liability exclusions in Section 8 apply.

8 Liability and Disclaimer

8.1 Liability

Liability is governed by applicable statutory provisions. However, Tradiziun GmbH is not liable under any circumstances for slight negligence, indirect and consequential damages, lost profits, unrealized savings, damages resulting from delayed delivery, or any actions or omissions on the part of Tradiziun GmbH.

In the following cases, any liability is rejected:

  • improper, non-contractual or illegal storage, setting or use of the products;
  • Use of incompatible spare parts or accessories (e.g. power supply);
  • failure to maintain and/or improper modification or repair of the products by the customer or a third party;
  • force majeure, in particular natural disasters, moisture, falls and impact damage.

8.2. Limitations of liability

Any liability for losses or damages of any kind – whether direct, indirect, or consequential – arising from the use of or access to the website or from links to third-party websites is excluded. Despite all due care, we cannot guarantee the flawless functioning of the website. We disclaim any liability for unauthorized manipulation of the Internet user's computer system.

9 Payment

9.1 Payment options

Tradiziun GmbH issues all invoices in Swiss francs.

Unfortunately, cash payment is only possible for pickup. In this specific case, payment in a foreign currency can be negotiated.

If you pay by credit card or other instant payment method, the amount will be charged when you place your order.

For advance payment, delivery will only take place after receipt of payment. The products will be reserved until the payment deadline of at least 14 days has elapsed.

When purchasing on account, the customer is obligated to pay the invoice amount within 30 days of receipt of the delivery without any deductions not shown on the invoice. In the event of a partial return of the delivered products, the invoice amount may be reduced accordingly.

9.2 Default in payment

If the customer fails to meet his payment obligations in whole or in part, all outstanding amounts will be immediately demanded and further deliveries of products will be stopped.

We charge a processing fee of CHF 5.00 for the second reminder and CHF 20.00 for the third reminder. If reminders are unsuccessful, the invoiced amounts may be assigned to a debt collection agency. In this case, an additional effective annual interest rate of up to 15% may be charged on the outstanding invoice amount from the due date. The debt collection agency will collect the outstanding amounts in its own name and for its own account and may charge additional processing fees.

9.3 Retention of title

Ordered products remain the property of Tradiziun GmbH until full payment is received. Pledging, transfer of ownership by way of security, processing, or modification is not permitted before full payment.

10 Change of order or cancellation

Placing an order obligates you to accept the products. We may accept subsequent changes or cancellations of orders at our sole discretion and charge a handling fee of 20% of the canceled order value, with a minimum of CHF 20.

If a delivery impossibility arises after an order has been placed, the customer will be informed immediately. If the order has already been paid, the amount will be refunded. If no payment has been made, the order will be canceled. Further claims due to delayed or non-delivery delivery are excluded.

11 Repair outside the warranty

The costs for repairs outside the warranty according to Section 7 are borne by the customer. For products that do not exhibit any detectable defects or where the defect is not covered by the warranty according to Section 7, we reserve the right to charge the customer for the costs of examining the claimed defect as well as the shipping costs.

12 Final provisions

12.1 Partial invalidity

Should individual provisions of these Terms and Conditions be invalid or ineffective, this shall not affect the validity of the remaining provisions and these Terms and Conditions as a whole.

12.2 Place of jurisdiction and applicable law

All legal relationships between Tradiziun GmbH and its customers are governed by Swiss substantive law. The Vienna Sales Convention does not apply.

The following exclusive places of jurisdiction apply:

For all claims arising from purchase contracts in which Tradiziun GmbH is a party, the place of jurisdiction shall be Samedan.
